The driver was charged on Tuesday after investigators concluded that he allegedly activated the emergency brakes too close to a stationary commuter train, leaving insufficient time to prevent the collision.
The crash occurred on April 28 near Bekasi Timur station, when a long-distance train slammed into the rear of the stationary commuter train.
Sixteen passengers travelling in a women-only carriage were killed in the collision. The carriages are designated for female passengers as part of measures aimed at protecting women from sexual harassment during their daily commute.
Jakarta police official I Dewa Putu Gede Anom Danujaya said investigators determined that the emergency braking could have been initiated from a greater distance.
“Investigators concluded that the emergency braking action could have been carried out further away,” Danujaya said at a press conference.
The driver has not been arrested and remains free as the case proceeds.
A report by Indonesia’s National Transportation Safety Committee found that signalling and communication system failures were among several factors that contributed to the crash.
The collision caused significant damage to the train carriages, with rescuers working for hours to free passengers trapped in the wreckage.
